INFORMATIVA SUI RIMBORSI E DIRITTO DI RECESSO
Diritto di recesso ai sensi degli artt. 52 e ss. del Codice del Consumo

Ai sensi dell’art. 52 del Codice del Consumo, hai il diritto di recedere dal contratto concluso con il Venditore, senza alcuna penalità e senza specificarne il motivo, entro quattordici (14) giorni, decorrenti dal giorno del ricevimento dei prodotti acquistati su jazz-jeans-moda.myshopify.com . In alcuni casi specifici, debitamente segnalati nella sezione Diritto di Recesso, sarà possibile cambiare il prodotto con un altro.
Jazz Jeans & Moda ti permette di farlo entro quattordici giorni(14) come richiesto dalla legge.

Per recedere dal contratto puoi utilizzare, a tua scelta, una delle seguenti modalità, conformemente all’art. 54 del Codice del Consumo: -2.1) utilizzo del Modulo di reso (conforme al modulo tipo ai sensi dell’art. 49, comma 4 del Codice del Consumo) da compilare e trasmettere direttamente on line attraverso l'indirizzo e-mail a-s.srls@virgilio.it). -2.2) utilizzo di questo modulo (conforme al modulo tipo ai sensi dell’art. 49, comma 4 del Codice del Consumo) da compilarsi e trasmettere al Venditore; -2.3) invio al Venditore di una qualsiasi altra dichiarazione esplicita della tua decisione di recedere dal contratto.
Qualora tu scelga di utilizzare il Modulo di reso da trasmettere direttamente on line attraverso l'e-mail a-s.srls@virgilio.it , -2.4) il Venditore ti invierà conferma a mezzo e-mail dell’avvenuto ricevimento della richiesta di recesso.
Qualora tu scelga, invece, di inviare altra dichiarazione di recesso, l’onere di provare il corretto e tempestivo esercizio del diritto di recesso, graverà su di te.

Una volta esercitato il recesso dal contratto, dovrai restituire i prodotti al Venditore consegnandoli al corriere, o presso i negozi Jazz Jeans&Moda, per la spedizione entro quattordici (14) giorni che decorrono da quando hai comunicato al Venditore la tua decisione di recedere dal contratto.

Le uniche spese a tuo carico sono quelle di restituzione dei prodotti acquistati se utilizzerai il corriere come metodo di restituzione.

Il Diritto di Recesso - oltre al rispetto dei termini e delle modalità di cui agli art. 52 e ss. del Codice del Consumo, descritti ai precedenti punti 2.1, 2.2, 2.3 e 2.4 - si intende esercitato correttamente qualora siano interamente rispettate anche le seguenti condizioni:
a) il Modulo di reso trasmesso direttamente on line attraverso l'indirizzo di posta elettronica nuovetribu.srl@virgilio.it , questo modulo o altra dichiarazione esplicita della tua decisione di recedere dal contratto devono essere correttamente compilati e trasmessi al Venditore entro quattordici (14) giorni dal ricevimento dei prodotti;
b) i prodotti non devono essere stati utilizzati, indossati, lavati;
c) i prodotti devono essere restituiti nella loro confezione originale (nel caso di CD audio, libri, oggetti di design, designer toys e giochi da grandi, la confezione deve essere sigillata come in origine;
d) se vuoi rendere un kit, devi restituire tutti gli articoli che lo compongono);
e) i prodotti resi devono essere consegnati allo spedizioniere entro quattordici (14) giorni che decorrono da quando hai comunicato al Venditore la tua decisione di recedere dal contratto;
f) i prodotti non devono essere danneggiati.
g) il timborso non verrà effettuato se non vi sarà presente la comprovata richiesta da parte del compratore al venditore sull'effettiva disponibilità del prodotto attraverso i canali di contatto che troverà nella sezione contatti nel sito o al punto 4.3 dei Termini e Condizioni del servizio

Se il Diritto di Recesso è esercitato seguendo le modalità ed i termini indicati in questo paragrafo 20, il Venditore provvede a rimborsare le eventuali somme già incassate per l'acquisto dei prodotti secondo le modalità ed i termini previsti.

Le somme ti saranno rimborsate nel minore tempo possibile ed, in ogni caso, entro quattordici (14) giorni dalla data in cui il Venditore è venuto a conoscenza dell'esercizio del tuo diritto di recesso, provvederemo ad attivare le procedure di rimborso, una volta verificata la corretta esecuzione dei termini e delle condizioni sopra indicate, come indicato nell'Informativa sui rimborsi e diritto di recesso.

Qualora non siano rispettate le modalità ed i termini per l'esercizio del tuo diritto di recesso, di cui alle lettere a), e), g), f) del precedente paragrafo 5, non avrai diritto al rimborso delle somme già corrisposte al Venditore. Entro 14 giorni dall’invio della e-mail con cui ti sarà comunicata la mancata accettazione del reso, potrai scegliere di riottenere, a tue spese, i prodotti nello stato in cui sono stati restituiti al Venditore, dandone comunicazione al Venditore stesso, secondo le modalità che ti saranno comunicate. In caso contrario, il Venditore potrà trattenere i prodotti, oltre alle somme già pagate per il loro acquisto.

Qualora non siano rispettate le condizioni, non avrai diritto all'integrale rimborso delle somme già corrisposte al Venditore. Sarai, infatti, responsabile della diminuzione di valore dei prodotti restituiti, conseguente da un utilizzo diverso da quello necessario allo scopo di consentirti di accertare la natura, le caratteristiche ed il funzionamento dei prodotti stessi. In questa ipotesi, dal rimborso previsto sarà detratta una percentuale compresa tra il 10 ed il 90 percento delle somme da te corrisposte al Venditore per l’acquisto dei prodotti restituiti, secondo quanto ti sarà specificamente comunicato, via posta elettronica, dal Venditore.

Entro 14 giorni dall'invio della e-mail con cui ti sarà comunicata la somma detratta dal rimborso, potrai scegliere di riottenere, a tue spese, i prodotti nello stato in cui sono stati restituiti al Venditore, dandone comunicazione al Venditore stesso, secondo le modalità che ti saranno comunicate. In caso contrario, il Venditore potrà trattenere i prodotti e un importo corrispondente alla percentuale detratta sul rimborso.

RESI

Puoi richiedere il cambio o il reso per qualsiasi prodotto entro 30 giorni dalla data di consegna.

Per avere diritto di reso il prodotto non deve essere stato usato e deve trovarsi nella stessa condizione in cui è stato ricevuto. Inoltre deve essere nell'imballaggio originale.

Per completare la restituzione, richiediamo la ricevuta o prova di acquisto.

Si prega di non inviare il prodotto al produttore.

RIMBORSI(OVE APPLICABILE)

Una volta ricevuto e ispezionato, invieremo un'email per notificare il ricevimento dell'articolo. Notificheremo anche l'accettazione o il rifiuto del rimborso.
Se la richiesta viene accettata, il rimborso sarà processato, e un credito sarà automaticamente assegnato alla tua carta di credito oppure secondo il metodo originale di pagamento, entro alcuni giorni.

Mancanza del rimborso o rimborso in ritardo (ove applicabile)

Se ancora non hai ricevuto il rimborso, ti preghiamo prima di controllare il tuo conto bancario nuovamente. Dopo contatta il servizio clienti della carta di credito: a volte ci vuole un po’ di tempo per vedere concluso il rimborso.
Dopo contatta la tua banca. Di solito ci sono dei tempi necessari di lavorazione prima che il rimborso sia concluso.

Se l'articolo è stato contrassegnato come regalo dall’acquirente quando è stato acquistato ed è stato spedito direttamente a te, riceverai un buono regalo per il valore del tuo reso. Una volta ricevuto l'articolo da te restituito, ti verrà inviato un buono regalo.
Se l'oggetto non è stato contrassegnato come un regalo al momento dell'acquisto, o se il donatore ha fatto spedire l'ordine a se stesso per fornirti l'articolo in seguito, invieremo un rimborso al donatore e lui verrà a sapere della tua restituzione.

Tu sarai responsabile di pagare le spese di spedizione per la restituzione del tuo articolo. Le spese di spedizione non sono rimborsabili. Se ricevi un rimborso, il costo della spedizione di ritorno verrà detratto dal tuo rimborso.
A seconda di dove vivi, il tempo necessario affinché tu riceva l’articolo cambiato può variare.
Se si spedisce un articolo oltre € 75, è consigliabile considerare l'utilizzo di un servizio di spedizione tracciabile o l'acquisto di un'assicurazione sulla spedizione. Non possiamo garantire che riceveremo l'articolo restituito.

INFORMATION ON REFUNDS AND RIGHT OF WITHDRAWAL
Right of withdrawal pursuant to arts. 52 and ss. of the Consumer Code

Pursuant to art. 52 of the Consumer Code, you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on jazz-jeans-fashion.myshopify .com. In some specific cases, duly reported in the Right of Withdrawal section, it will be possible to change the product with another one.
Jazz Jeans & Fashion allows you to do so within fourteen days (14) as required by law.

To withdraw from the contract you can use, at your choice, one of the following methods, in accordance with art. 54 of the Consumer Code: -2.1) use of the Return Form (conforming to the standard form pursuant to Article 49, paragraph 4 of the Consumer Code) to be completed and transmitted directly online via the e-mail address nuovetribu.srl @ virgilio.it -2.2) use of this form (conforming to the standard form pursuant to Article 49, paragraph 4 of the Consumer Code) to be completed and transmitted to the Seller; -2.3) sending the Seller any other explicit statement of your decision to withdraw from the contract.
-2.4) If you choose to use the Return Form to be sent directly online via e-mail nuovetribu.srl@virgilio.it, the Seller will send you confirmation by e-mail of receipt of the request for withdrawal.
If you choose, instead, to send another declaration of withdrawal, the burden of proving the correct and timely exercise of the right of withdrawal, will weigh on you.

Once you have withdrawn from the contract, you must return the products to the Seller delivering them to the courier, or to the Jazz Jeans & Fashion stores, for shipment within fourteen (14) days starting from when you have notified the Seller of your decision to withdraw from the contract.

The only expenses charged to you are those for returning the products purchased if you use the courier as a method of return.

The Right of Withdrawal - in addition to compliance with the terms and conditions set out in art. 52 and ss. of the Consumer Code, described in paragraphs 2.1, 2.2, 2.3 and 2.4 above - it is intended to be correctly exercised if the following conditions are fully met:
a) The Return Form transmitted directly online via the email address nuovetribu.srl@virgilio.it, this form or other explicit declaration of your decision to withdraw from the contract must be correctly completed and transmitted to the Seller within fourteen (14 ) days from receipt of products;
b) the products must not have been used, worn or washed;
c) the products must be returned in their original packaging (in the case of audio CDs, books, design objects, designer toys and games for adults, the package must be sealed as originally;
d) if you want to make a kit, you must return all the items that compose it);
e) the returned products must be delivered to the forwarder within fourteen (14) days starting from when you have notified the Seller of your decision to withdraw from the contract;
f) the products must not be damaged.
g) the payment will not be made if there is no proven request from the buyer to the seller on the actual availability of the product through the contact channels that will be found in the contacts section on the site or in point 4.3 of the Terms and Conditions of the service

If the Right of Withdrawal is exercised following the procedures and terms indicated in this paragraph 20, the Seller will reimburse any sums already collected for the purchase of the products according to the methods and terms provided.

The amounts will be reimbursed as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the reimbursement procedures once verified the correct execution of the terms and conditions indicated above, as indicated in the information on refunds and right of withdrawal.

If the methods and terms for exercising your right of withdrawal are not respected, as per letters a), e), g), f) of paragraph 5 above, you will not be entitled to reimbursement of the sums already paid to the Seller. Within 14 days from the sending of the e-mail with which you will be notified of the non-acceptance of the return, you can choose to re-collect, at your expense, the products in the state in which they were returned to the Seller, notifying the Seller, according to the methods that will be communicated to you. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.
If the conditions are not respected, you will not be entitled to full reimbursement of the sums already paid to the Seller. In fact, you will be responsible for the reduction in value of the returned products, resulting from use other than that necessary for the purpose of enabling you to ascertain the nature, characteristics and functioning of the products. In this case, a percentage of between 10 and 90 percent of the sums paid by you to the Seller for the purchase of the returned products will be deducted from the reimbursement envisaged, according to what will be specifically communicated to you by e-mail by the Seller.

Within 14 days from sending the e-mail with which you will be notified of the sum deducted from the reimbursement, you can choose to re-collect, at your expense, the products in the state in which they were returned to the Seller, giving notice to the Seller, according to the methods that will be communicated to you. Otherwise, the Seller may retain the products and an amount corresponding to the percentage deducted on the reimbursement.

RETURNS

You can request a change or return for any product within 30 days from the delivery date.

To be entitled to return the product must not have been used and must be in the same condition in which it was received. It must also be in the original packaging.

To complete the return, we request a receipt or proof of purchase.

Please do not send the product to the manufacturer.

REFUNDS(IF APPLICABLE)

Once received and inspected, we will send an email to notify you of receipt of the item. We will also notify you of the acceptance or refusal of the refund.
If the request is accepted, the refund will be processed, and a credit will be automatically assigned to your credit card or according to the original method of payment, within a few days.

Lack of late repayment or repayment (if applicable)

If you have not received a refund yet, please check your bank account again. After contacting the credit card customer service: sometimes it takes some time to see the repayment ended.
Then contact your bank. Usually there are necessary processing times before the reimbursement is concluded.

Only normal-price items can be reimbursed, unfortunately the items on offer can not be reimbursed.

CHANGE (WHERE APPLICABLE)

PRESENTS

If the item was marked as a gift by the buyer when it was purchased and shipped directly to you, you will receive a gift certificate for the value of your return. Once you receive the item you returned, you will be sent a gift certificate.
If the item has not been marked as a gift at the time of purchase, or if the donor has sent the order to himself to provide you with the item later, we will send a refund to the donor and he will know about your return.

If you send an item over € 75, consider using a traceable shipping service or purchasing a shipping insurance. We can not guarantee that we will receive the returned item.
